These Terms of Use form an agreement between you and Sacred Blue Studios ("we", "us", "Jokerz") governing your access to and use of the Jokerz website, applications, and related services (together, the "Service"). If you do not agree, you may not use the Service.
You must be at least 19 years of age and a resident of a jurisdiction where our Service is lawful to use. By creating an account, you represent that you meet these requirements. We may ask you to verify your age at any time and may suspend or terminate accounts that do not.
Jokerz is a free-to-play skill-and-prediction game. You earn virtual coins, scores, and leaderboard positions that exist only inside the Service. Virtual coins and scores:
The Service is not a lottery, wagering contest, or gaming operation within the meaning of the Canadian Criminal Code, the Ontario Gaming Control Act, or comparable legislation. No consideration paid to us results in a prize of real-world value.
You are responsible for the security of your account credentials and for any activity on your account. You must provide accurate profile information and keep it up to date. You may not create an account on behalf of someone else, impersonate another person, or maintain more than one active account.
Your use of the Service is subject to our Acceptable Use Policy. In short: don't cheat, scrape, harass, or break the law while using the Service. We may suspend or terminate access for violations.
The Service, including its software, card art, and content, is owned by Sacred Blue Studios or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable licence to use the Service for personal, non-commercial purposes. NBA statistics are used for reference under applicable fair-dealing exceptions; the NBA and NBA teams are not affiliated with or endorsing Jokerz.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, our liability for any claim arising out of or relating to the Service is limited to the greater of (a) amounts you paid us in the 12 months preceding the claim, or (b) CAD $100. We are not liable for indirect, incidental, consequential, or punitive damages.
You may stop using the Service at any time. We may suspend or terminate your access for any reason, including suspected breach of these terms, abuse, or legal/regulatory requirements.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute that is not otherwise resolved informally.
We may update these terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated terms. Material changes will be communicated in-app or by email.
